HRS Section 201H-38 requires the City Council to adopt, with or without modifications, or reject the resolution. It must act on the 201H-38 resolution within 45 days after receipt of the report.

A developer may submit an application for 201H-38 exemptions to the state’s Hawai‘i Housing Finance and Development Corpo- ration (HHFDC) or the city Department of Planning and Permitting (DPP).
After the agency (HHFDC or DPP) processes the appli- cation, it submits a report to the City Council with findings and recommendations, togeth- er with the project’s prelimi- nary plans and specifications.
If the Council fails to act within that period, the project and requested exemptions are deemed approved as submit- ted. This is why there is an urgency for the Council to act quickly.
